Terms of Use
Effective Date: March 25, 2025
These Terms of Use (“Terms”) govern your access to and use of the Ready First (R1) platform and website at www.youthreadyfirst.com, operated by The Ready Collective, Inc. (“The Ready Collective,” “we,” “us,” or “our”). By creating an account or using R1, you agree to these Terms. If you do not agree, do not use the platform.
1. Eligibility and Account Registration
R1 is designed for use by parents and guardians on behalf of youth athletes ages 18 and under, and by coaches and administrators affiliated with registered clubs, teams, or National Governing Bodies (NGBs). To create an account, you must be at least 18 years old. If you are registering on behalf of a minor, you represent that you have the legal authority to do so.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
2. Permitted Use
R1 is provided for the purpose of athlete readiness assessment and communication within registered sports organizations. You may use R1 only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the platform to collect or store data about athletes without proper authorization and parental consent
- Share, resell, or distribute R1 data, reports, or outputs to unauthorized third parties
- Attempt to reverse engineer, decompile, or extract source code from the platform
- Use automated scripts, bots, or scrapers to access R1 data
- Impersonate another user, coach, or administrator
- Use R1 to make or communicate clinical diagnoses, medical decisions, or formal psychological evaluations
3. Not a Medical or Clinical Service
R1 is a readiness visibility platform, not a medical service. The data, scores, and feedback generated by R1 are informational in nature and do not constitute medical advice, clinical diagnosis, or treatment recommendations. R1 is not a substitute for professional medical evaluation, mental health services, or qualified sports medicine care.
If you have concerns about an athlete’s physical or mental health, consult a qualified healthcare provider.
4. Data and Intellectual Property
All platform software, algorithms, scoring models, and content are the proprietary intellectual property of The Ready Collective, Inc. You may not copy, reproduce, or create derivative works from R1 platform content without express written permission.
Assessment responses and readiness data you submit remain subject to the terms of the Privacy Policy. You grant The Ready Collective a license to use de-identified, aggregated data for research, product development, and reporting purposes consistent with the Privacy Policy and any applicable research consent forms.
5. Research Participation
R1 is currently conducting a longitudinal study under an IRB-approved research protocol through Stanford University. Research participation is voluntary and governed by a separate Research Consent Form. If you choose to participate, your data will be used as described in that form. You may withdraw from research participation at any time without affecting your access to the R1 platform.
6. Disclaimer of Warranties
R1 is provided “as is” and “as available.” The Ready Collective makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the platform or its outputs. We do not warrant that the platform will be uninterrupted, error-free, or free from security vulnerabilities.
7. Limitation of Liability
To the fullest extent permitted by law, The Ready Collective, Inc. and its founders, officers, employees, and advisors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of R1. Our aggregate liability for any direct damages will not exceed the amount you paid to use the platform in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless The Ready Collective, Inc. and its personnel from any claims, damages, or expenses (including reasonable legal fees) arising from your use of R1, your violation of these Terms, or your violation of any third-party rights.
9. Third-Party Platforms
R1 integrates with NGB registration platforms operated by third parties, including SportsEngine, TeamUnify, Sport:80, Sports Connect, and PlayMetrics. These platforms are not operated by The Ready Collective. We are not responsible for their functionality, data practices, or terms. Use of those platforms is governed by their respective terms and privacy policies.
10. Termination
We reserve the right to suspend or terminate your access to R1 at any time for violation of these Terms, conduct that harms the integrity of the platform or its users, or at our discretion with reasonable notice.
You may close your account at any time by visiting our contact page. Account closure is subject to data retention obligations described in the Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in San Diego County, California.
12. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or in-platform notice at least 14 days before the changes take effect. Continued use of R1 after changes take effect constitutes acceptance of the revised Terms.
